What does EscrowAudit actually do?

We audit your annual mortgage escrow analysis statement against the Real Estate Settlement Procedures Act (RESPA, 12 C.F.R. §§ 1024.17 and 1024.36) — checking cushion ceiling, surplus/shortage handling, tax-projection accuracy, math reconciliation, and state interest law. If we find errors, we generate a Qualified Written Request (QWR) letter that your servicer is legally required to respond to within 30 business days.

Is the audit accurate?

Our rules engine is deterministic — every finding cites the specific RESPA section it's based on. We use independent AI-based extraction (Gemini 3.1 Flash-Lite primary, Claude Haiku 4.5 fallback), validated to F1 = 1.000 on a 15-statement synthetic eval, with a Claude Opus 4.8 reviewer arbitrating any ambiguity. Math itself is never delegated to an LLM — all arithmetic uses banker's rounding via Decimal.js.

Are you a law firm?

No. EscrowAudit is a self-help computer software service. We prepare documents based solely on information you supply. The borrower is the sole author of the QWR letter. No attorney-client relationship is created. Read the full disclaimer.

What is a Qualified Written Request (QWR)?

A QWR is a written notice that triggers RESPA Section 6 obligations (12 U.S.C. § 2605, 12 C.F.R. § 1024.36) on the loan servicer: they must acknowledge receipt within 5 business days and respond substantively within 30 business days. Failure to comply exposes them to actual damages plus statutory damages up to $2,000 for a pattern of noncompliance, plus attorney's fees.

How long does the audit take?

What file formats can I upload?

PDF, PNG, JPEG, or HEIC. Up to 20 MB. Every upload is content- validated against its declared MIME type (magic-byte check) — a file that claims to be a PDF but isn't one is rejected before it reaches storage.

What does the audit actually check?

Five categories of RESPA violations:
  • Cushion ceiling— 12 C.F.R. § 1024.17(c)(1)(ii): servicer cushion can't exceed one-sixth of annual disbursements.
  • Surplus handling — § 1024.17(f)(2)(i)–(ii): surpluses ≥ $50 must be refunded within 30 days; under $50 may be credited.
  • Shortage spread — § 1024.17(f)(3)(i)–(ii): shortages must be spread over at least 12 months.
  • Math reconciliation — projected balances recomputed from disbursements vs. statement values; any drift is flagged.
  • State interest law — 15 states require interest on escrow balances; we check rate compliance.

What happens to my uploaded statement?

Stored in Supabase Storage (US region), accessible only by your account through row-level security. Automatically deleted 90 days after the audit unless you subscribe to the Annual Monitor. See the privacy policy for full retention details.

What if my servicer ignores the QWR?

Non-response after 30 business days entitles you to: actual damages, statutory damages up to $2,000 for a pattern or practice of noncompliance, attorney's fees and costs (12 U.S.C. § 2605(f)). You can also file a CFPB complaint or sue in federal court. We generate complaint drafts as part of the audit.
